Terms of Service
These terms apply to your use of www.lynellagency.com and to the services provided by Lynell Agency (“Lynell Agency”, “we”, “us”), a web design and Google Ads management agency based in Los Angeles, California. By using the site or engaging us, you agree to them.
In short: Access you give us to your Google Ads account is used only inside Lynell Agency, to provide your Google Ads management. No third parties get access to your data, and we do not sell it.
1. Our services
We design and build websites and landing pages, write copy, set up call and form tracking, provide hosting and maintenance, and manage Google Ads campaigns. The scope, timeline and fees for each project are set out in a written proposal or agreement. If that agreement conflicts with these terms, the agreement controls for that project.
2. Authorization to access your accounts
To manage Google Ads for you, we need access to your Google Ads account. You authorize us to access and manage the accounts you connect, through Google’s own permission screen or by invitation to your account. You confirm that you have the authority to grant that access. You can remove our access at any time at myaccount.google.com/permissions or in your Google Ads account settings. We use that access only for our own internal work for you, which is providing Google Ads management as your client. No third party has access to your account data through us, and we do not sell it. 3. Your responsibilities
- Give us accurate information, content and approvals in a timely way.
- Make sure the content, products and claims in your ads and on your site are lawful and that you have the right to use any materials you give us.
- Follow the terms and advertising policies of Google and any other platforms we use on your behalf.
4. Fees and advertising spend
Fees are as stated in your proposal or agreement. Advertising spend is paid directly to Google and is separate from our fees. We do not control what Google charges. You are responsible for your ad spend and for the budgets you approve.
5. Ownership
Ownership of the website design, code, content and domain for each project, and any licences to third-party materials, will be stated in your agreement. You keep ownership of materials you give us. We may show completed work in our portfolio unless you tell us in writing that you would rather we did not.
6. No guarantee of results
We work to improve your calls, quote requests and bookings, but we cannot guarantee any particular ranking, traffic, number of leads or return on ad spend. Results depend on many things we do not control, including competition, your offer, your pricing and platform changes.
7. Third-party services
We rely on third-party services such as Google, Cloudflare and others. They have their own terms, and we are not responsible for their outages, policy changes or actions, including suspension of an advertising account.
8. Website use
You agree not to misuse the site, for example by attempting to disrupt it, access it without permission, or submit unlawful or misleading information. The sample websites in our Work section are examples of our design work. Reviews, prices and details shown in them are placeholders, and some feature fictional businesses.
9. Limitation of liability
To the fullest extent the law allows, Lynell Agency is not liable for indirect, incidental or consequential losses, including lost profits or revenue. Our total liability for any claim relating to our services is limited to the fees you paid us for the services giving rise to the claim in the three months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
10. Ending the relationship
Either of us may end an engagement as set out in the agreement. When it ends, we will remove our access to your accounts when you ask us to, hand over what you own under the agreement, and delete your Google Ads data as described in the Privacy Policy. Fees for work already done remain payable.
11. Changes and governing law
We may update these terms and will post the new version here with a new date. These terms are governed by the laws of the State of California, and disputes will be handled in the courts located in Los Angeles County, California.
